PAOC Summary - March 17th
Summary- PAOC March 17,2010
Larawence Wilson stated round 1 rebid went much smoother
due to supplier education and on line registration.
Covered document review was used
by a ssubstantial amount of bidders.
CMS is on track to announce the single payment
amounts in June 2010.
CMS will conduct extensive outreach and education
activities for providers once the single payment amounts
are announced.
Medicare contractors will provide educational materials
on their websites and in their bulletins and newsletters.
PAOC members were surprised that CMS did not solicit
their input before designing the materials.
CMS provided an overview of the role of the Medicare.
Competitive Acquisition Ombudsman, who will respond
to concerns and complaints from suppliers and individuals
regarding the competitive bidding program.
CMS presented a tentative timeline for Round 2 with
Bidder registration and education events will begin in
winter 2010. Program registration will end and the
bidding process will begin in spring 2011.
CMS is considering closing the registration process before
the bidding window opens. CMS plans to expand
the covered document review process to 90 days, up
from 45 days from the first round.
Single payment amounts for Round 2 will be announced
Spring 2012, educational and outreach activities will begin
summer 2012 and the program will be implemented in
January 2013.
PAOC members said that more time is needed to educate
suppliers outside of the Round 1 MSAs on the program,
as there is little existing knowledge.
PAOC members also suggested that Round 2 be
implemented on a rolling schedule to allow focus on the
new MSAs and prevent CMS and the CBIC from
being overwhelmed.
PAOC also asked how diabetic mail-order supplies
would be handled, and CMS said that issue would be
addressed in future rulemaking.
CMS said Medicare requirements and the supplier
standards that must be met to participate in the competitive
bidding program. For example, contract suppliers must maintain
enrollment, accreditation and licensure as part of their contract.
CMS noted that suppliers may not sell or assign a contract
to another entity. While there is a change of ownership procedure
in place, it is to prevent suppliers from bidding simply to later
sell the contract.
CMS also outlined the beneficiary survey form and the supplier
quarterly report form that will be used. PAOC members said
suppliers should have been consulted in the development of
the forms. In addition, PAOC members said that adequate
oversight is needed to ensure the program is successful.

HEALTHCARE Penalty & HR3790 ? REMEDY?
Today, we enter a new era of of government
controlled health care.
As an industry, we are being penalized with
an additional tax of 2.5% for medical devices
which manufacturers will pass along to us.
We are being harassed with needless audits by
overzelous fee paid audit contractors.
We are being singled out as "crooks" because
a few "bad apples" have been fraudulent.
We do not receive credit for supporting
mandatory accreditation.
surety bonds and the development and
support of a 13 point fraud program.
We are always guilty of fraud even when our
mistakes are inadvertent ones.
Yet because of CMS's failure to enforce the law,
make site visits more than once every 20 years
(to verify legitimate DME business) and failure
to verify new providers as legitimate,
we suffer the wrath.
The government is now involved in the largest
price fixing scheme ever,as they move to drive down
reimbursement to an all time low.
CMS will, by the provisions of the
newly passed health care bill, use
Competitive Bidding rates as a benchmark for
allowables nationwide.
They will accelerate the rates even lower
and every insurance company and HMO
will follow suit.
Has anyone taken the time to

HOUSE RELEASES CHANGES
Washington DC --Late Sunday night, the House
released the text of changes which will serve
as base legislation for changes to the Senate bill.
The budget committee released over 2300 pages
that was previously recommended to the
Education and Labor Committee as well as the
Ways & Means Committee.
Substantive changes will be offered
during the markup process.
It appears both houses will work together to
approve the sweeping changes to health care.
With reconciliation looming on the horizon,
it is likely the approval of the health care
reform act will be before the Easter recess.
A filibuster is now out of the question.
There will be no further debate on
government run health care or what it
will actually cost every American.
It is time to get involved and let your member
know how you feel about reconciliation.
Be sure to discuss the current Senate
provision, such as a NEW 2.5% excise
tax on medical equipment.
Now is the time to get on the phone,
send emails and faxes to make your voice
heard.
Give your member an earfull.

discussed the status of HR 3790.
She thanked him for his introduction of the bill
and discussed further actions to move the bill forward.
In addition Mr. Terry Wylie, TAHCS government relations committee and Brian Robertson, representing TAHCS Board member Jason Hall, attended.

GOOD NEWS HR3790
HR3790 is rapidly gaining support throughout the country.
During the AMEPA Rally for HR 3790 in California,
2 California members of Congress signed on as cosponsors.
This brings our total to 142 Co-Sponsors
and we expect more from California in the near future.
AMEPA is working hard and we are working
with them to secure more Texas co-sponsors
for HR 3790.
Thanks to Rob & Sean for their efforts
in California.
Illinois is next while we look for a Senator
to introduce HR3790 to Repeal Competitive Bidding.

There were no findings of fraud with any audit.
Providers were relieved to be released from
100% prepayment audits since these audits
created cash flow problems.
The Legal Counsel has sent a list of questions
regarding the audits but has yet to receive an
answer from the ZPIC counsel.

CMS has announced they will delay Medicare implementation
of CR6417 and CR6421 (the PECOS edits) until Jan. 3, 2011.
CMS has announced this further delay of the physician registration
requirement to allow physicians and non-physician practitioners
who order services or items, or refer Medicare beneficiaries
to other Medicare providers, sufficient time to enroll or update their
Medicare credentials.
Finally CMS is beginning to listen to the DME industry !

and restore the paymentsfor oxygen services through the beneficiaries
medical need period as introduced by Rep. (Dr.) Price of Georgia.
Currently the bill has 82 co sponsors. We need additional cosponsors to
schedule it for a committeehearing in the house. Ask your member of
congress to support and cosponsor HR 2373 to restore oxygen care for our seniors.

ZPIC Audit Update
According to the TAHCS general counsel,the first supplier
has been released from ZPIC audits which
included 100% prepayment audit.
This is a direct result of objections made by TAHCS general
counsel to the excessive number of audits preformed,
implementation of the 100% prepayment punishment status
and the excessive length of time required to complete the audits.
When contacted, the ZPIC counsel indicated it was not their
intent to "strangle" the providers, but rather to complete
their audits to rule out fraud and abuse.
Furthermore, the ZPIC has ceased telling providersthese
are random audits, after it was discoveredby general counsel,
all audits were pointed and fraud based.

billing practices and are designed to find fraud.
The Texas Counsel for ZPIC has indicated it was not their
intent to "strangle suppliers".
Guess they do not understand when withholding the
supplier's reimbursement, before they are found
guilty of wrongdoing, will have an impact on cash flow.
Unfortunately, the audit procedures and
100 % prepayment are having adverse
effects on small business.
Going to the penalty phase of the audit procedure
manages to skip all other reasonable methods
for correcting billing procedures, such as education,
as noted in the Integrity Manual.
Perhaps they are making the audit rules as they go along?

HR 3790 to Repeal Competitive Bidding
Washington DC --- HR 3790 is gaining more support
for this budget neutral bill which would repeal Competitive Bidding.
As of 02-01-2010, we have 138 cosponsors which include some notable
members such as Minority Leader Boehner (OH), Congressman Nathan Deal (GA),
Co-Policy Bluedog Chair Barron Hill (IN).
HR 3790 has picked up support in Texas by members of congress
such as Ralph Hall (Tx), EB Johnson (Tx), Henry Cuellar (Tx),
Louie Gohmert (Tx), Charles Gonzalez (Tx), Solomon Ortiz (Tx)
and, TedPoe (Tx) and Ciro Rodriquez (Tx).
If allowed to implement, it is estimated that 300,000 to 500,00
jobs will be lost. Home Care magazine has reported thousands
of providers have already been eliminated due to CB.
Texas co-sponsorship is certainly bipartisan as well as other states.

Dallas Texas --- TAHCS has established dialog with the
general counsel for Health Integrity LLC.
We are attempting in to determine how and why many of the
DME providers were placed on 100% prepayment audit before other
steps were taken as outlined in the program integrity manual.
Some providers are reporting more than 500 requests for audits in
a wide variety of equipment and supplies. One supplier was audited
after their claim was denied and no appeals requested.
There appears to be no common factor in the selection for audits
at this time. And these a "samplings" appear unusual due to the
numbers requested.
Generally speaking , statistically fewer audits
could be performed to accomplish the same goal.

CLAIM AUDITS without Notice
ZPIC IN TEXAS
The Zero Program Integrity Contractor, Health Integrity LLC,
has been auditing providers throughout Texas.
It has been noted that every audit results in a 100% prepayment
audit. Each audit may take up to 120 days or longer before providers will be
returned to normal reimbursement.
HI has decided to go directly to the penalty phase of non compliance
with every provider suffering a 100% prepayment audit while
their audit is in progress.
FYI: HI has other mechanisms available, before 100% prepayment is invoked,
as set forth in CMS guidelines but so far has chosen not to use these procedures.
HI states providers are not considered guilty of fraud and this is a
random audit process.
No information is available as to the internal workings of this audit
process at this time. TAHCS will reach out to this contractor
to better understand the process and report back.
We understand audits range from 1 claim audited while other
providers have received up to 500 audits in less than one week.
Providers claim these audits are excessive and immediately hurt
the cash flow for small business.
Be advised that you may be on 100% prepayment until
HI considers your billing has passed their audit.
If you receive an audit request, it may be wise to call HI and
ask if you are on 100% prepayment audit.
Also, ask how long before you will be released.
HI advises providers they will determine when providers
will be released and no time periods have been given to inquiring providers.
TAHCS advises you comply with the audits while we have our legal counsel
explore possibilities of other action.

GOOD NEWS
As of today, HR 3790 has 135 cosponsors and continues it's momentum.
We are still exploring a Senate sponsor, but with all the activity
on healthcare it is difficult to get a Senator at this time.
Continue to call you member of congress!
Urge them to support this budget neutral bill which:
a. Saves over 633,000 jobs
b. Provides continued Access to Care for 10 Million Medicare
beneficiaries
c. Saves the tax payer $25 million annually
d. More cost effective than the original demonstration projects
in Polk County Fla. and San Antonio Texas.
e. Replaces a severely flawed and unrepairable program
